What is the definition of a Relocation Dispute?
A relocation dispute arises when one parent wants to move a child more than 50 miles from the current home and the other parent objects. Florida law treats this as a formal request needing either written agreement or a court order. The dispute is decided on the child’s best interests.
What Counts as Relocation
- A move over 50 miles for 60 or more consecutive days
- Includes moves within Florida and out of state
- Requires written agreement of the other parent or a judge’s permission
How Courts Decide
Judges weigh the child’s ties to the community, the impact on timesharing, the reason for the move, and whether the move improves the child’s life. A parent who moves without permission can face court sanctions and a modified timesharing schedule.
