What is the definition of Modification of Custody?
A modification of custody is a court order that changes an existing timesharing arrangement after a divorce or paternity case is final. Florida courts require a substantial, unanticipated change in circumstances before reopening the schedule.
What Qualifies
- A parent relocating or working hours that no longer fit the schedule
- Concerns about a child’s safety or a parent’s stability
- A child’s needs changing with age or schooling
- Repeated violations of the existing parenting plan
How the Court Decides
The judge weighs the change against the child’s best interests, including stability and each parent’s track record. Emergency changes need immediate danger; ordinary changes go through a supplemental petition and hearing.
