What is the definition of the Discovery Process?
The discovery process is the formal exchange of information between spouses before a divorce trial. Each side uses sworn tools to learn what assets, income, and facts the other side holds.
Main Discovery Tools
- Interrogatories, which are written questions answered under oath
- Requests for production of bank, retirement, and business records
- Subpoenas directed at third parties, including employers
- Depositions, where testimony is taken live and transcribed
Why It Matters
Discovery uncovers non-marital assets, hidden income, and the true value of a marital estate. A spouse who hides assets during discovery risks sanctions and an unequal equitable distribution award.
